1. Introduction

Welcome to Automotive Experience. These Terms & Conditions ("Terms") govern your access to and use of the automotiveexperience.com website and any associated services, features, and content (together, the "Service").

The Service is operated by Automotive Experience Pty Ltd (ABN 41 673 922 855) ("Automotive Experience", "we", "us", or "our"), registered at 1 Sussex St, Barangaroo NSW 2000, Australia.

Automotive Experience is a directory and discovery platform. We help users discover automotive events organised by independent third parties. We do not organise, host, run, or operate any events listed on the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms operate alongside our Privacy Policy and Cookie Policy, which are incorporated by reference.

2. Eligibility

You must be at least 18 years old to create an account on Automotive Experience. By registering, you confirm that you meet this age requirement and have the legal capacity to enter a binding contract.

If you are using the Service on behalf of a business, you confirm you have authority to bind that business, and references to "you" include that business.

We may suspend or terminate accounts that breach this requirement or any other provision of these Terms.

3. Accounts

We offer user accounts for individuals discovering events and business accounts for event organisers, venues, and businesses listing events or purchasing featured placements.

You agree to provide accurate, current, and complete information when registering, and to keep that information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

To close your account, email admin@automotiveexperience.com. We will action account closure within a reasonable period. See our Privacy Policy for details on data deletion timelines.

4. Event Listings & Third-Party Content

All events listed on the Service are organised and operated by independent third parties ("Event Organisers"). We do not organise, run, host, sponsor, endorse, or verify any event.

We review event submissions before publishing them, but review is limited to basic suitability and policy compliance. It is not a verification of accuracy, safety, legality, or quality. You are responsible for verifying event details directly with the Event Organiser before attending or making any commitment.

Attendance is at your own risk. Automotive events may involve inherent risks including vehicle movement, loud noise, weather exposure, and crowd conditions. We accept no liability for any loss, injury, damage, or disappointment arising from your attendance at or interaction with any event or Event Organiser.

• Event Organisers are solely responsible for the accuracy, completeness, and currency of event information, including dates, times, locations, pricing, and changes.
• Event Organisers are solely responsible for the conduct, safety, and execution of events.
• Event Organisers are solely responsible for compliance with all applicable laws, permits, insurance, and venue rules.
• Event Organisers are solely responsible for any tickets, refunds, exchanges, or admission policies relating to their events.

5. User-Submitted Content

If you submit content to the Service, including event submissions, descriptions, photos, comments, or other materials ("User Content"), you confirm that you own the content or have all necessary rights and permissions to submit it.

You retain ownership of your User Content. By submitting it, you grant Automotive Experience a non-exclusive, royalty-free, worldwide, transferable, and sublicensable licence to host, store, reproduce, display, distribute, modify for formatting, publish, and promote the User Content in connection with the Service.

This licence includes the right to feature User Content in our marketing materials, social media channels, newsletters, search results, and promotional content. The licence survives termination of your account in respect of content already published or used.

We may remove, edit, or refuse to publish any User Content at our discretion, without notice, and without liability.

• Your content must not infringe any third party's intellectual property, privacy, publicity, or other rights.
• Your content must be accurate and not misleading.
• Your content must comply with these Terms and applicable law.

6. Prohibited Conduct

You agree not to misuse the Service.

• Do not submit false, misleading, fraudulent, or impersonating content.
• Do not submit unlawful, harassing, defamatory, obscene, hateful, discriminatory, or unsafe-driving content.
• Do not submit content that infringes intellectual property, privacy, or publicity rights.
• Do not upload viruses, malware, or code designed to disrupt the Service.
• Do not scrape, harvest, or extract data from the Service by automated means without our prior written consent.
• Do not reverse engineer, decompile, or attempt to extract source code from the Service.
• Do not use the Service to send spam or unsolicited communications.
• Do not circumvent access controls, account suspensions, or technical restrictions.
• Do not use the Service for any unlawful purpose or in breach of these Terms.

7. Business Featured Listings

Business accounts may purchase featured listing placements through the Service. Featured listings are paid promotional placements processed through Stripe.

A featured listing provides 30 days of featured placement within the city and country you selected at the time of purchase.

Payments are processed by Stripe. By purchasing a featured listing, you agree to Stripe's terms. We do not store full card details on our servers.

All featured listing purchases are final. No refunds are available once the listing is live, except where we fail to deliver the service as described or where a refund is required under applicable consumer protection law.

Featured listing content remains subject to these Terms. We may remove featured listings that breach these Terms without refund.

8. Intellectual Property

The Service, including its design, code, branding, logos, text, graphics, and arrangement, but excluding User Content, is owned by or licensed to Automotive Experience and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works of the Service without our prior written consent. Automotive Experience and associated logos are our trade marks and may not be used without our prior written consent.

9. Third-Party Services & Links

The Service may contain links to third-party websites, services, or integrations, including Event Organiser sites, payment processors, social media, mapping, and analytics tools. We do not control and are not responsible for the content, availability, terms, or privacy practices of any third-party service. Use of any third-party service is at your own risk and subject to its own terms.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties, conditions, and representations of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and uninterrupted availability.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law or any equivalent legislation. Where a consumer guarantee applies and cannot be excluded, our liability is limited to the extent permitted by law.

• We do not warrant that the Service will be uninterrupted, error-free, secure, or virus-free.
• We do not warrant that event listings or other content are accurate, complete, or current.
• We do not warrant that any Event Organiser is reputable, licensed, insured, or capable of delivering its event.
• We do not warrant that any event will be held, will be safe, or will meet your expectations.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or exemplary loss or damage, including loss of profits, revenue, data, goodwill, opportunity, or enjoyment.

We are not liable for any loss arising from the conduct of, or content provided by, Event Organisers, users, or any third party.

Our total aggregate liability arising out of or in connection with the Service and these Terms is capped at the greater of AUD $100 or the total fees you have paid to us in the 12 months immediately preceding the claim.

Nothing in this clause limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify and hold harmless Automotive Experience, its officers, employees, and agents from and against any claims, losses, damages, liabilities, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your User Content, your breach of these Terms, or your violation of any law or third-party right.

13. Suspension & Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, misused the Service, or where required for legal, security, or operational reasons.

You may stop using the Service or close your account at any time. Clauses that by their nature should survive termination will do so, including clauses on User Content licence, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution.

14. Changes to These Terms

We may update these Terms from time to time. The publication date at the top reflects the latest version. Material changes will be notified through the Service or by email where reasonable. Your continued use of the Service after an update constitutes acceptance of the updated Terms.

15. International Users

Automotive Experience is operated from Australia. If you access the Service from outside Australia, you are responsible for complying with local laws. The Service is not directed at jurisdictions where its content or operation would be unlawful.

16. Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales, Australia have non-exclusive jurisdiction to resolve any dispute arising out of or in connection with these Terms or the Service. Nothing prevents either party from seeking urgent injunctive or equitable relief in any court of competent jurisdiction.

17. General

These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us in relation to the Service. If any provision is found unenforceable, the remainder remains in force. Our failure to enforce any provision is not a waiver of that provision.

You may not assign these Terms without our written consent. We may assign these Terms to any successor or affiliate. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.
